What can I do if my application has been refused?

There is a set timeframe for an appeal depending on whether you are outside the UK (28 days) or inside the UK (14 calendar days, unless you are detained in which case it is five days). You will be notified in the decision letter as to whether you have a right to appeal. The types of cases that are covered by appeals include:

    Refusal to enter or remain in the UK
    Deportation of an individual currently in the UK
    Refusal of an asylum claim

The appeal process

The appeal is heard at the First-tier Tribunal. If the appeal is allowed then the person can either enter the UK or remain in the UK if they are already here. If the appeal fails then you may be able to appeal to the Upper Tribunal if certain circumstances are met.
